ANY RELIGIOUS RITE THAT CAUSES PAIN AND AFFECTS DIGNITY OF A PERSON IS INHUMAN: MADRAS HIGH COURT

During a revision of a judgment, the Madras High Court said that any religious rite which causes pain, suffering and affects the dignity of a person cannot be justified even it has been followed for a very long period, and should be considered inhuman attracting penal punishment. The observation was made while allowing an appeal filed by four women who were punished by a trial court for their involvement in the exorcism of their daughter-in-law. However the Judge, taking into consideration the passage of 17 years from the date of occurrence and the age of the accused, who were all women, modified the sentence of one-year imprisonment to a term already undergone by them.
