CONSUMER FORUM REJECTED A WOMAN PLEA AFTER 8 YEARS SAYING THAT SHE FILED PLAINT BY A YEAR LATE, GUJARAT FORUM REVERSED THE ORDER AND ORDERED COMPENSATION 1.2 LAKH

The Consumer Dispute Redressal Forum in Surat took eight years to tell a litigant that she was late by a year in filing a complaint about the loss of vision in her left eye, caused by the implantation of defective lens during a cataract surgery, and rejected the complaint in 2011. It had sat on it since 2003. This delay was highlighted by the Gujarat State Consumer Dispute Redressal, which reversed the forum’s order. But it took another seven years for the commission to rectify the error.  So the complainant had to wait for 15 years (2003-2018) to get justice in the form of compensation of Rs 1.20 lakh. The commission directed distributors of the lens to pay Rs 45,000 to the woman for her surgery and doctor’s consultancy, Rs 25,000 for legal expenditure, and Rs 50,000 for causing mental agony.

SUPERIOR IS NOT RESPONSIBLE IF STAFFER ENDS LIFE DUE TO WORKLOAD: SUPREME COURT

The Supreme Court has said that if any employee is troubled due to excessive work in the office and he commits suicide due to this, then the boss will not be responsible for this. The court said that because of giving more work to the employee, it can’t be assumed that his boss is a criminal and he has given more work to exploit the employee or motivate him to commit suicide, and dismissed the argument of the Bombay High Court that the officer was culpable even if there was no direct abetment on the grounds that the conditions created could lead to unbearable mental tension.

HYDERABAD HIGH COURT ISSUED NOTICE TO TELANGANA STATE, CENTRE ON ROAD SAFETY MEASURES

The Hyderabad High Court directed the Centre and Telangana state governments to file affidavits explaining the steps taken to mandating the contractors to maintain adequate safety standards as mandated by the Ministry of road transport and Highways and as well as those given in Indian Road Congress Codes without any deviation. The court was dealing with a suo motu taken up based on a letter by Mr V. B. Rama Rao, a resident of Ameerpet in city. The bench issued notices to the respondents and posted the matter to July 17 for further hearing.

GOVERNMENT MAY GIVE BAIL TO UNDERTRIAL WOMEN PRISONERS WHO HAVE SPENT ONE-THIRD OF PUNISHMENT

The ministry of women and child development has sought relaxation in provisions of the Code of Criminal Procedure (CrPC) to allow bail to undertrial women inmates in jails, who have spent one-third of their maximum possible sentence in detention. Based on the study titled 'Women in Prison’, the changes have been proposed to Section 436A of CrPC, which provides for release of an inmate on bail after half of the maximum sentence has been served. It also recommended exempting undertrial women from the mandatory production of surety in court for grant of bail.

CONSUMER FORUM ORDERED AEGON RELIGARE INSURANCE COMPANY TO PAY RS 7.4 LAKH TO INSURED PERSON

The Hyderabad District Consumer Forum has ordered Aegon Religare Life Insurance Company Limited to refund a city resident his policy amount and compensation for Rs 2 lakh. The petitioner found that the terms and conditions explained by the company representative and the terms printed on the policy documents were different. He cancelled the policy but not got the total money back. Later he filed case in consumer forum. The forum ordered company to pay Mr Kumar Rs 5 lakh with 18 per cent interest per annum, Rs 2 lakh for the mental agony and hardships caused and Rs 40,000 towards costs.

TEACHER SLAPPING STUDENT DOES NOT ENCOURAGE SUICIDE: MADHYA PRADESH HIGH COURT

The Madhya Pradesh High Court said that if a teacher chastises a child for indiscipline, it doesn't make a case for abetment to suicide, and dismissed a petition filed by the uncle of a Class X student who hanged herself in November last year after being scolded by her principal.

COMPENSATE LEOPARD ATTACK VICTIM: CONSUMER FORUM IN HYDERABAD

A Consumer forum in the Hyderabad city ordered United India Insurance to pay insurance after the death of a person’s father in a leopard attack. The petition was filed by the Mr Kummari Sailu, the son of a farmer in Nizamabad. The post-mortem report stated that it was an ‘accidental death due to the bite of leopard’. It also ordered United India to pay Mr Sailu Rs 1 lakh with interest of 9 per cent per annum from February 3, 2015, and Rs 50,000 for the accidental death along with Rs 1,000 towards costs.

ANY RELIGIOUS RITE THAT CAUSES PAIN AND AFFECTS DIGNITY OF A PERSON IS INHUMAN: MADRAS HIGH COURT

During a revision of a judgment, the Madras High Court said that any religious rite which causes pain, suffering and affects the dignity of a person cannot be justified even it has been followed for a very long period, and should be considered inhuman attracting penal punishment. The observation was made while allowing an appeal filed by four women who were punished by a trial court for their involvement in the exorcism of their daughter-in-law. However the Judge, taking into consideration the passage of 17 years from the date of occurrence and the age of the accused, who were all women, modified the sentence of one-year imprisonment to a term already undergone by them.

SUPREME COURT AGREED TO HEAR PLEA CHALLENGING CENTRE’S DECISION TO CREATE A SOCIAL MEDIA HUB

A vacation bench of the Supreme Court agreed to hear a plea on the Centre’s decision to create a Social Media Communication Hub (SMCH). The petition was filed by Trinamool Congress (TMC) MLA Mohua Moitra's alleging that the Centre’s decision to set up social media hub would violate an individual’s right to privacy.

LAW MINISTER SAID THAT 791 CASES AGAINST MPs/MLAs SHIFTED TO 12 FAST TRACK COURTS FOR SPEEDY TRIAL

Law minister Ravi Shankar Prasad said that the government has transferred 791 cases against MPs/MLAs to 12 fast track courts set up for speedy trial. The 12 fast track courts have been set up in 11 states by the government on the direction of the Apex Court for speedy trial of cases against lawmakers. The Election Commission has also demanded debarring convicted MPs/MLAs from contesting elections.

CONSUMER FORUM FINED 61000 AGAINST A CONSULTANCY FOR FAILING TO PROVIDE VISA ON TIME

A district consumer forum in Hyderabad directed a private consultancy to pay Rs 61,191 to a consumer for failing to provide visa on time.  The forum said that the consultancy should have returned the fees, instead of making them wait and giving childish excuses, and directed them to refund the money and costs and compensation.

TELANGANA GOVERNMENT TO SET UP CHILD PROTECTION UNITS IN ALL 31 DISTRICTS

The Telangana state government will soon establish 'District Child Protection Units (DCPU)' in all 31 districts. Units will coordinate and implement child rights and prevent abuse of children. Currently, these units are located in 10 districts. Work has been taken up to cover the remaining 21 districts. Its objectives were to prevent child abuse, and protect children, and also primarily to ensure implementation of the Juvenile Justice Act.

LITIGATION NOTICE SERVED IF SENT ON WHATSAPP AND BLUE TICKS CAN BE SEEN: BOMBAY HIGH COURT

While hearing an application filed by SBI Cards and Payment Services to execute an arbitration award against a Nalasopara resident, Rohidas Jadhav, relating to payment of credit card dues of Rs 1.17 lakh, the Bombay high court has held that service of notice about a litigation through WhatsApp is valid according to the enactment of the Information Technology Act, which recognises electronic communication as evidence, and observed that the blue ticks on the message revealed that Jadhav, who was evading the bank had received the lawyer's notice in a PDF message and read it, then it is considered as proof that the physical copies of the messages have been accepted the respondent.

NRI MARRIAGES NEED TO BE REGISTERED WITHIN 7 DAYS: MINISTRY OF WOMEN AND CHILD DEVELOPMENT

The Ministry of Women and Child Development said that all NRI marriages solemnised in India would need to be registered within seven days.  If the NRI marriages are not registered within seven days, the passports and visas would not be issued. The decision for mandatory registration of marriages within seven days was taken after a group of ministers met to map out legal solutions for redressing the issues faced by women in NRI marriages.

HYDERABAD HIGH COURT ISSUED NOTICE TO CENTRE, AND TELANGANA GOVERNMENTS ON LAND OWNERSHIP

The Hyderabad High Court issued notices to the Centre and the Telangana governments asking them to respond to a PIL seeking to make certain amendments to the Land Transfer Regulation Act, 1970. The PIL was filed by Sureddy Ramana Reddy, a resident of Chunchupally village in Bhadradri Kothagudem. The petitioner moved the PIL as a party in person seeking to declare that the Regulation 31(a) of the Telangana Scheduled Areas Land Transfer Regulation 1959 as amended by Regulation No I of 1970 to the extent it deprives the right of residence of non-tribals in the scheduled areas in Telangana as illegal and violative of Article 14 19 and 21 of the Constitution.

MINIMIZE USE OF PRIVATE VANS FOR TRANSPORTING SCHOOL KIDS: BOMBAY HIGH COURT

The Bombay High Court asked the Maharashtra government to take steps to minimize the use of vans to transport school children. The observations were made during the hearing of a PIL filed by the PTA United Forum, which alleged that the safety of children was being compromised as rules for issuing permits to school buses were not being strictly enforced. The court also asked state authorities to put in place a helpline and a complaint redressal mechanism.

MADRAS HIGH COURT QUASHED CRIMINAL COMPLAINT AGAINST BSNL EMPLOYEES WHO PUT SMILING FACE WITH TEARS EMOJI IN OFFICIAL WHATSAPP GROUP

The Madras High Court quashed the FIR against 46 BSNL employees, who are facing criminal cases for posting an emoji of crying with laughter in reply to a woman colleague's 'serious message' on an official WhatsApp group, and stated that an emoji was sent to express one's feeling about something, and cannot be treated as an overt act against others.

SCHOOL CAN'T SEND CHILDREN OUT OF CLASSROOM, DIRECTOR AND PRINCIPAL CONVICTED BY A DELHI COURT

A Delhi Court has convicted the director and Principal of a school on the charges of causing mental trauma to a seven-year-old student for not allowing her to enter the classroom. They were given a two-month jail term for the misconduct towards the child, which is a crime according to the Juvenile Justice (Care and Protection) Act, and also slapped a fine of Rs 2.5 lakh each to the Director and Principal of the school.

ALL NRI MARRIAGES TO BE REGISTERED WITHIN 48 HOURS, ELSE PASSPORT, VISA COULD BE REVOKED: MINISTRY OF WOMEN AND CHILD DEVELOPMENT

All NRI marriages solemnised in India would have to be registered within 48 hours, else the passport and visas would be revoked or not issued said by the Maneka Gandhi, Union Minister of Women and Child Development (WCD). This development comes amid an increased instance of look-out notices being issued against Non-Resident Indians (NRIs) abandoning their wives in India. The WCD Ministry is in the process of issuing orders to the registrars that details of such marriages should be provided to it so that a central database can be maintained.

LAW TO PUNISH PERSONS WHO CIRCULATE INDECENT PORTRAYALS OF WOMEN ON SOCIAL MEDIA ON ANVIL

The Centre has proposed a higher jail term and penalty to curb circulation of indecent portrayals of women on social media and other forms of digital communication. The ministry of women and child development proposed amendments to widen the scope of Indecent Representation of Women (Prohibition) Act, 1986, with violators facing jail terms of up to three years and a fine of Rs 2 lakh. The bill will be sent for the Cabinet permission.

SHE TEAM REGISTERED 62 CASES IN MAY ALONE: ADMIN-INCHARGE OF SHE TEAMS

The SHE teams of Cyberabad are reorganising, by increasing their number from four to seven, to address the rising number of complaints from women and also to monitor the nuisance created by persons in public places. Admin-Incharge of SHE teams said that they have received around 600 petitions from complainants in the first half of 2018 alone. In May alone SHE team registered 20 cases of eve-teasing and 14 cases of cell phone stalking, under Cyberabad limits. All the accused were asked to attend counselling.

CENTRE LAUNCHED PORTAL TO REPORT ONLINE CHILD PORN, RAPE CONTENT

The Centre has launched a centralised online portal www.cyberpolice.gov.in and helpline number 155260 to receive complaints pertaining to child pornography and rape/gangrape (CP/RGR) content, and also the centre wrote to all the states asking them to designate a nodal cyber cell, preferably in the state police headquarters, appoint nodal officers for handling complaints/content received online by June 15, 2018.
