ARBITRATOR DOESN’T HAVE ALL COURT’S POWERS: HYDERABAD HIGH COURT

A division bench of the Hyderabad High Court made it clear that an arbitrator was not equal to a court and does not have all the powers that are vested in a civil court and set aside the order of the XV additional district judge, Rangareddy district at Miyapur referring the parties to arbitration, when a third party is included as a defendant in the suit, and the court said that it is for the civil court to decide the suit on merits.
