POCSO ACT IS GENDER-NEUTRAL, INCLUDE MALE CHILD SURVIVORS OF SEXUAL ABUSE IN VICTIM COMPENSATION SCHEME: CENTRE

Maneka Gandhi, Minister for Women and Child Development has written to all states and union territories asking them to ensure that the male child survivors of sexual abuse or exploitation are included in the victim compensation scheme. The minister has also highlighted that POCSO Act is gender neutral and safeguards the interest of not only the girl child but also the male child. The compensation awarded by the special court is to be paid by the state government from the victims’ compensation fund.

ARBITRATOR DOESN’T HAVE ALL COURT’S POWERS: HYDERABAD HIGH COURT

A division bench of the Hyderabad High Court made it clear that an arbitrator was not equal to a court and does not have all the powers that are vested in a civil court and set aside the order of the XV additional district judge, Rangareddy district at Miyapur referring the parties to arbitration, when a third party is included as a defendant in the suit, and the court said that it is for the civil court to decide the suit on merits.

NO LIMIT IN SEEKING HELP ON UNCERTAIN SIGNATURES IN DOCUMENTS: HYDERABAD HIGH COURT

The Hyderabad High Court has made it clear that when a dispute arises in respect of signatures in documents, the disputed signatures can be referred to an expert along with concurrent admitted signatures, calling for his opinion at any stage of the case proceedings before a court. The Court also noted that there was no limitation to take such steps and could call for records available with the officials to resolve the dispute.

SUPREME COURT DENIED RELIEF TO PREGNANT DELHI UNIVERSITY STUDENT BARRED FROM EXAMS FOR LOW ATTENDANCE

The Supreme Court refused to allow Ankita Meena, a second year law student of Delhi University to appear at the fourth semester examination for which she was barred by the University for being short of attendance due to pregnancy. She had first moved the Delhi High Court which refused her plea and later challenged the High Court order in the Apex Court. However, the Court has granted liberty to the petitioner to seek remedy from the Division Bench of the Delhi High Court.

IS ONE BOARD FOR ALL SCHOOLS FEASIBLE: SUPREME COURT ASKED CENTRE RESPONSE

The Supreme Court issued notice to the Centre seeking its response on the probability of introducing ‘One Nation-One Education Board’ in the country under which all schools would have a common syllabus. The court granted eight weeks’ time for the government to file its response.

SUPREME COURT IMPOSED 1LAKH FINE EACH ON SOCIAL NETWORKING SITES FOR NOT PREVENTING CHILD PORN

The Supreme Court imposed a cost of Rs 1 lakh each on Yahoo, Facebook Ireland, Facebook India, Google India, Google Inc, Microsoft and WhatsApp for not taking effective measures to prevent child porn and rape videos on social media networks. The court also directed them to file responses by June 15, 2018.

GOVERNMENT AUTHORITIES CANNOT REFUSE TO CONDUCT LAND SURVEY: HYDERABAD HIGH COURT

The Hyderabad High Court made it clear that it is mandatory for authorities to conduct land surveys when requested and when there is a dispute about procedural lapses or some other related issues, the aggrieved party can seek justice from the court. The court has left it open to the petitioner to avail appropriate remedy as available in law against the endorsement of Tahsildar rejecting the survey.

WON’T ALLOW ARREST OF INNOCENTS EVEN IF CENTRE MAKES LAW: SUPREME COURT ON SC/ST ACT RULING

The Supreme Court said that it would not allow arrest of innocent people without a fair procedure on complaints filed under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC/ST Act) even if Parliament made a law, and asserted that it has protected the fundamental rights to life and liberty of innocents by ordering prior scrutiny of complaints.

SUPREME COURT ISSUED NOTICE TO CENTRE ON PLEA BY IIT STUDENTS CHALLENGING SECTION 377

The Supreme Court issued notice to the Centre seeking its reply on a petition filed by a batch of 20 people, current and former students of Indian Institutes of Technology, for scrapping Section 377 of India Penal Code which makes carnal intercourse a crime punishable upto ten years of imprisonment.

LIFE TAX ON VEHICLES TO BE LEVIED ON INVOICE PRICE AND NOT ON THE EX-SHOWROOM PRICES: HYDERABAD HIGH COURT

The Hyderabad High Court made it clear that transport authorities are entitled to collect life tax from the owner of a vehicle only on the price he paid for owning it and not on the ex-showroom prices, directed the Hyderabad transport authorities to refund 51,000 excess tax collected from a Hyderabad resident. The judge pronounced this order after hearing a petition filed by Kishore Rai Sohini who challenged the way the authorities are calculating and determining the life tax to be paid.

SUPREME COURT ISSUED NOTICE TO CENTRE, STATES ON IN-HOUSE PHARMACIES

The Supreme Court sought a response from the Centre, states and Union Territories on a PIL alleging patients are compelled to buy medicines from the in-house pharmacy stores of hospitals and are prevented from buying them in the open market. The Public Interest Litigation (PIL) filed by practicing lawyer Vijay Pal Dalmia contended that patients admitted in private hospitals are being made to suffer considerable financial losses through the forced purchase of drugs from in-house pharmacies.

SET UP ANTI-SEXUAL HARASSMENT PANELS IN ALL COURTS: SUPREME COURT

The Supreme Court asked all High Courts to set up anti sexual harassment committees in courts across the country within two months as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. The court made this order while hearing a petition filed by a practising woman advocate who alleged that she had been assaulted by some lawyers during a strike at the Tis Hazari district court complex in New Delhi.

SOON, ROAD ACCIDENT VICTIMS TO GET 10-FOLD INCREASE IN COMPENSATION

The Central government is all set to increase the minimum compensation payable to road accident victims or their family members by 10 times. It suggested that the compensation payable would be applicable in cases where victims die, face permanent disability and even minor injuries, irrespective of income and age.  It has also kept a provision open for individuals to approach the Motor Accident Claims Tribunal (MACT), in cases where they seek higher compensation for their loss.

CENTRE, NALSA FIXED COMPENSATION FOR VICTIMS OF RAPE, UNNATURAL SEXUAL ASSAULT, ACID ATTACK

The National Legal Services Authority has come up with a relief policy offering a minimum amount of Rs 5 lakh and Rs 7 lakh respectively as an aid to poor women who go through financial crisis after a sexual assault or an acid attack. NALSA has drawn up this scheme in collaboration with the Centre. NALSA’s scheme has been prepared after the Supreme Court order seeking ‘model rules’ to succour to women victims and their family members, particularly the poor and residents of rural areas lacking resources to fight legal battles.

SUPREME COURT RESERVED VERDICT ON PETITIONS CHALLENGING VALIDITY OF AADHAAR

A five-judge bench of the Supreme Court reserved its verdict on a bunch of petitions, led by ex-high court judge K Puttaswamy, challenging the constitutional validity of Aadhaar on the ground that it violated citizens’ right to privacy, and directed all the parties concerned to file their written submissions to put forth their case.

RAILWAYS LIABLE TO PAY COMPENSATION IF PASSENGER DIES WHILE BOARDING AND DEBOARDING TRAINS: SUPREME COURT

The Supreme Court ruled that the railways would be liable to pay compensation to passengers in case of death or injury while boarding and de-boarding trains and said it cannot deny such claims citing negligence on the part of passengers. A bench of Justices held that death or injury during boarding or de-boarding a train will be an 'untoward incident' entitling the victim to compensation.

CHIEF JUSTICE OF INDIA IMPEACHMENT ROW: SUPREME COURT DISMISSES CONGRESS PLEA AS WITHDRAWN

Two Congress MPs, who had moved the Supreme Court challenging Rajya Sabha Chairman M Venkaiah Naidu’s April 23 decision to reject the impeachment notice against Chief Justice of India Dipak Misra, withdrew their petition following sharp exchanges with a five-judge bench which did not answer their query on who constituted the bench to hear their matter.

SUPREME COURT REJECTS CENTRE’S PLEA TO STAY ITS VERDICT ON SC/ST ACT

The Supreme Court refused to stay its March 20 judgment diluting the provision of mandatory arrest under the SC/ST (Prevention of Atrocities) Act, and set aside the Centre’s charge that the verdict marked an intrusion into the sphere of the legislature and rewriting of the law.

CENTRAL GOVERNMENT TO BRING LAW ON DNA PROFILING OF UNIDENTIFIED BODIES

The Union government informed the Supreme Court that it will enact a law for DNA profiling of all unidentified bodies, which could help unravel the link between missing persons and those dead, and that bill could probably be tabled during the monsoon session of Parliament.
