SUPREME COURT DECRIMINALISED SECTION 377 AND LEGALISED HOMOSEXUALITY


The Supreme Court said that gay sex among consenting adults is not an offence after hearing a batch of petitions challenging the Constitutional validity of Section 377 of the Indian Penal Code that criminalises homosexuality. Calling Section 377 irrational and arbitrary, the court stressed that the LGBTQ community enjoys the same rights as other citizens under the Constitution. The Supreme Court also said that other aspects of Section 377 dealing with unnatural sex with animals and children will remain in force.
