SUPREME COURT ALLOWED ENTRY OF WOMEN OF ALL AGES INTO SABARIMALA TEMPLE


The Supreme Court allowed the entry of women of all ages into the Sabarimala Ayyappa temple in Kerala. Till now, women in the 10-50 age groups were denied entry on the ground that they were of menstruating age. The court termed this centuries-old Hindu religious practice as illegal and unconstitutional and paved the way for women’s worship at par with men. The Court said that Right to worship is given to all devotees and there cannot be any discrimination on the basis of gender.

SUPREME COURT REFUSED TO REVIEW NAMAZ IN MOSQUE PETITION AND SAID IT WILL ONLY HEAR AYODHYA LAND DISPUTE


The Supreme Court declined to refer to a five judge constitution bench the issue of reconsideration of the observations in its 1994 judgement that a mosque was not integral to Islam which had arisen during the hearing of the Ayodhya land dispute case. In a majority verdict of 2:1, an Apex Court bench said that the civil suit has to be decided on the basis of evidence, adding that the previous verdict has no relevance to this issue. The court said that the civil suit on land dispute will be heard by a newly constituted three-judge bench on October 29.

SUPREME COURT AGREED LIVE-STREAMING OF COURT PROCEEDINGS


The Supreme Court agreed to live-streaming and video recording of court proceedings, saying “sunlight is the best disinfectant”. The top court said that live streaming of crucial hearings will accomplish the 'public right to know' and bring in more transparency in judicial proceedings. However, the Bench added that necessary rules for balancing the rights of public and protecting dignity of litigants will be placed soon.

SUPREME COURT APPROVED SC/ST QUOTA IN JOB PROMOTIONS, AND SAID COLLECTING DATA ON BACKWARDNESS NOT NEEDED


The Supreme Court refused to set up 7-judge bench to review its 2006 order on the SC/ST quota in job promotions. The Apex Court ruled that there will be no reservation in promotion for SC/STs in government jobs. The court said that there is a need for quantifiable data to give reservation. The Court also said that there is no need to collect data on SC/ST in reservation in promotion in government services.

SUPREME COURT UPHOLD AADHAAR’S CONSTITUTIONAL VALIDITY AND SAID AADHAAR NEEDED FOR PAN, NOT FOR BANK ACCOUNT AND SIM CARDS


The Supreme Court upheld the validity of the Aadhaar Act terming it a beneficial legislation, but weeded out provisions which had the potential for misuse. The Court said that the Aadhaar card is mandatory for PAN (Permanent Account Number) linking, for filing of IT returns and allotment of PAN, and for receiving any subsidy, benefit or services under welfare schemes. The court also said that Aadhaar will no longer be mandatory for opening bank accounts, buying mobile phone SIM cards, getting school admissions, or for appearing in boards or common entrance examinations.

LAWYERS ELECTED AS LAWMAKERS CAN PRACTICE IN COURTS: SUPREME COURT


The Supreme Court ruled that Advocates, who become law-makers, cannot be debarred from practising in courts. The Apex Court said that there was no express provision either under the Rules and the law regulating the profession of the lawyers to restrict them from practising on becoming members of Parliament, state assemblies or state councils. The Court said that Rule 49 was not applicable to law-makers who are not full time salaried employees.

CAN'T DISQUALIFY TAINTED NETAS: SUPREME COURT AND ASKED PARLIAMENT TO FRAME LAWS TO BAR THOSE ACCUSED OF CRIMES FROM FIGHTING ELECTIONS


The Supreme Court said that it was not within its powers to disqualify politicians facing criminal cases from contesting elections and recommended to Parliament to enact a strong law that makes it obligatory for political parties to remove leaders charged with heinous and grievous crimes, such as rape, murder and kidnapping, to name only a few, and refuse ticket to offenders in both parliamentary and Assembly polls. However, the court asked the candidates and political parties to give wide publicity to criminal cases pending against her/him in the local media, both print and electronic, after she/he files nomination to contest elections.

CENTRE LAUNCHED A WEB PORTAL FOR LODGING COMPLAINTS ON ONLINE CHILD PORNOGRAPHY, SEXUAL ABUSE CASES


The Centre launched a portal 'cybercrime.gov.in' where citizens can file complaints about circulation of child pornography, sexually explicit materials and online sexual abuse, leading to automatic registration of FIR and action against the offenders. This will not only help the victims and complainants but also civil society organisations and responsible citizens to anonymously report complaints pertaining to child pornography, child sexual abuse material or sexually explicit material such as rape and gang rape. It will enable complainants to report cases without disclosing their identity.

HYDERABAD HIGH COURT DIRECTED TELANGANA STATE POLICE NOT TO ARREST, PROSECUTE TRANSGENDERS


The Hyderabad High Court directed the Telangana state government not to register cases against them and not to make any arrests or investigate cases under the Telangana Eunuchs Act 1329 till further orders. The bench directed the police not to register any cases against transgenders under the Act.

To keep strict vigil on consumer courts across the country, especially at the district level, the Centre is set to install CCTVs so that the accountability can be fixed on erring officials for not performing their duty diligently. At present, there are more than 5 lakh consumer disputes cases pending in India. The high pendency is often linked to non-performance and vacancies.

SUPREME COURT AWARDED RS 50 LAKH COMPENSATION TO FORMER ISRO SCIENTIST IN ESPIONAGE CASE


The Supreme Court awarded Rs 50 lakh compensation to former ISRO scientist Nambi Narayanan for being subjected to harassment in a 1994 ISRO spy case. The court held that Narayanan (76) was unnecessarily arrested, harassed and subjected to mental cruelty by the Kerala police in the case. The bench ordered a probe into the role of Kerala police officers and set up a three-member panel headed by its former judge DK Jain to probe framing up of Narayanan in the spy case.

NO ROUTINE ARREST UNDER SC/ST ACT IF SENTENCE IN OTHER SECTIONS IS LESS THAN 7 YEARS: ALLAHABAD HIGH COURT


A Lucknow bench of Allahabad High Court said that police shouldn't make routine arrest in cases lodged under SC/ST Act if the maximum punishment in the case is less than seven years’ imprisonment. As per the Supreme Court guidelines, the investigating officer has to follow the provisions of Section 41 and 41 A of CrPC before making routine arrest in matters where offences under IPC are punishable up to maximum seven years. The investigating officer has to ensure that the arrest was essential, otherwise the judicial magistrate would not send accused to judicial custody.

SUPREME COURT SEEKS DETAILS OF CRIMINAL CASES PENDING AGAINST MPS, MLAS


The Supreme Court directed chief secretaries of 25 states and Union Territories and registrar general of their high courts to furnish details on the status of cases pending against MPs and MLAs. The court said that information was needed to decide on setting up of fast-track courts to exclusively deal with cases against lawmakers to dispose of them within a year. As of now, 12 such special courts are functioning in 11 states.

SUPREME COURT PULLED UP LOWER COURT IN JHARKHAND FOR DELIVERING VERDICT THROUGH WHATSAPP, SAYS IS THIS SOME KIND OF A JOKE


The Supreme Court has pulled up a Jharkhand trial court for using WhatsApp call to pronounce the order of charge to former minister of Jharkhand and his MLA wife, who are accused in a 2016 case where violent clashes between villagers and police had left four persons dead. The court took serious note of the submissions and said, what is happening in Jharkhand. This process cannot be allowed, and we cannot allow administration of justice to be brought into disrepute. We are seeing a trial being conducted through WhatsApp. This cannot be done. What kind of a trial is this? Is this a kind of joke? The Bench issued a notice on the plea by both the accused, who have sought transfer of their cases from Hazaribagh to New Delhi, and asked the state to respond to it within two weeks.

SEEKING SEXUAL FAVOURS PUNISHABLE UNDER NEW ANTI-CORRUPTION LAW

A senior government official said that Seeking and accepting sexual favours can be considered a bribe under the new anti-corruption law with the accused getting up to seven years jail term. The official said that under the Prevention of Corruption (Amendment) Act, 2018 investigating agencies like the CBI can now book officials for seeking and accepting sexual favours, expensive club memberships and hospitality or for providing employment to close friends or relatives among others.

SUPREME COURT REFUSED TO STAY AMENDED SC/ST ACT AND SEEKS CENTRE’S REPLY ON PLEAS AGAINST AMENDED SC/ST ACT


The Supreme Court refused to stay the amended Scheduled Caste/Scheduled Tribe (Prevention of Atrocities Act) passed recently by Parliament restoring the power of police to immediately arrest a person committing an offence under the law but agreed to hear the PILs and issued notice to the Centre to justify the validity of the amendment within six weeks.

SUPREME COURT GAVE STATES A WEEK TO IMPLEMENT JUDGMENT ON LYNCHING


The Supreme Court gave states one week to implement its judgement ordering the setting up of a procedure to prevent mob lynching incidents.  The Court said that only 11 of the 29 states and seven Union Territories (UTs) filed reports regarding compliance of its order directing them to take steps to deal with mob lynchings and cow vigilantism. Giving a week’s time, the bench directed the Centre and the States to widely announce on radio, television and other media platforms that lynching and mob violence will invite serious legal consequence.

SUPREME COURT DECRIMINALISED SECTION 377 AND LEGALISED HOMOSEXUALITY


The Supreme Court said that gay sex among consenting adults is not an offence after hearing a batch of petitions challenging the Constitutional validity of Section 377 of the Indian Penal Code that criminalises homosexuality. Calling Section 377 irrational and arbitrary, the court stressed that the LGBTQ community enjoys the same rights as other citizens under the Constitution. The Supreme Court also said that other aspects of Section 377 dealing with unnatural sex with animals and children will remain in force.

SUPREME COURT APPROVED SCHEME THAT GRANTS MINIMUM RS 4 LAKH COMPENSATION TO RAPE SURVIVORS


The Supreme Court has ruled that a rape survivor will get a mandatory minimum compensation of Rs 4 lakh and, in case of gang rape Rs 5 lakh, and directed states to implement this from October 2 in accordance with a scheme framed by the National Legal Services Authority (NALSA) in consultation with Centre. The monetary relief granted under the ‘compensation scheme for women victims/survivors of sexual assault and other crimes 2018’ is not linked with trial proceedings in such cases and the survivor can approach the state or district legal services authority for compensation immediately after registration of FIR.

SUPREME COURT TOLD I-T DEPARTMENT THAT APEX COURT IS NOT A PICNIC PLACE, FINED 10 LAKH ON IT FOR WRONG INFORMATION


The Supreme Court has slammed the income tax department for making misleading statement about pendency of an appeal while making it clear that the apex court is not a picnic place and cannot be treated like this, and slapped a cost of Rs 10 lakh on the department and said it was shocked that the Centre, through the commissioner of income tax, has taken the matter so casually. The court also noted that the plea was filed by the I-T department after a delay of 596 days and given inadequate and unconvincing explanation for the delay.
