The Supreme Court observed that purity of democracy cannot be
maintained if convicted leaders who are disqualified to contest elections, but
heading political parties are allowed to choose candidates to contest elections,
and decided to examine whether Section 29 (A) of the Representation of the
People Act (RPA) as to whether the Election Commission of India is empowered to
de-recognise the political party formed by a convicted person.
