CENTRE TO FILE REVIEW PETITION IN SUPREME COURT AGAINST SCHEDULED CASTE/ SCHEDULED TRIBES (SC/ST) ACT RULING

The Central government has decided to file a review petition before the Supreme Court next week challenging its order banning automatic arrests and registration of criminal cases under the Scheduled Castes (SC) and the Scheduled Tribes (ST) Prevention of Atrocities Act, 1989.

SUPREME COURT CHASTISED STATES FOR NOT GIVING INFORMATION ON WELFARE SCHEMES FOR WIDOWS AND DESTITUTE WOMEN

The Supreme Court has rebuked several states for not giving information to the Centre on the action plan for the uplift and welfare of widows and destitute women. The Court made this observation after perusing the compliance affidavit filed by the ministry of women and child development that the information given by certain states was incomplete, and directed all the states and union territories to provide full and complete information to the ministry within two weeks.

SUPREME COURT SHOCKED AT OVER 600 PER CENT OVERCROWDING IN JAILS

The Supreme Court said that it is unfortunate that the prisons are overcrowded, and they also have human rights and they cannot be kept in jails like animals. The Court also said that it is clearly suggests the complete lack of commitment of the State Governments and the Union Territories to the human rights of prisoners and also indicates the failure of the Under Trial Review Committees to take their responsibilities seriously, and directed the states and Union Territories to give their comments in two weeks on Standard Operating Procedures for the UTRCs, prepared in consultation with National Legal Service Authority (NALSA), so that they can work effectively and efficiently.

NO PASSPORT FOR GOVERNMENT OFFICERS FACING CRIME AND CORRUPTION CHARGES: CENTRAL GOVERNMENT

The government has decided to deny passports to government officers being investigated or prosecuted in corruption cases or facing FIR registered by a government entity after a preliminary enquiry. According to revised guidelines, such officers will not be given vigilance clearance needed for grant of passport. Vigilance clearance may also be denied to an officer under suspension or where a charge-sheet has been issued against the officer in pending disciplinary proceedings.

DEADLINE FOR LINKING AADHAAR WITH WELFARE SCHEMES EXTENDED TO JUNE 30, 2018

Deadline for linking of Aadhaar with the welfare schemes was extended by the Central government for three months. The new deadline is June 30, 2018, previous it is March 31, 2018. Already the deadline for linking bank accounts and mobile phone numbers with 12-digit biometric identifier Aadhaar has been extended indefinitely, till the five-judge constitution bench delivers its judgment on petitions challenging the validity of the biometric scheme and the enabling law.

CREAMY LAYER CONCEPT DOES NOT APPLY TO SC/STS: CENTRE TO SUPREME COURT

The Union government on Wednesday opposed the idea of a "creamy layer" within the Scheduled Castes (SC) and Scheduled Tribes (ST) category. The government told a Bench led by Chief Justice of India Dipak Misra that the principle of creamy layer cannot be applied to the presidential order on quota for SC/ST groups. The court was hearing a petition to exclude the affluent members or the ‘creamy layer’ of the SC and ST communities from accessing the reservation benefits.

SUPREME COURT SAID THAT CONVICTED LEADERS HEADING PARTIES AFFECTS DEMOCRACY

The Supreme Court observed that purity of democracy cannot be maintained if convicted leaders who are disqualified to contest elections, but heading political parties are allowed to choose candidates to contest elections, and decided to examine whether Section 29 (A) of the Representation of the People Act (RPA) as to whether the Election Commission of India is empowered to de-recognise the political party formed by a convicted person.

SUPREME COURT ASKED CHIEF SECRETARIES OF 12 STATES TO SPECIFY WHY THEY HAVE NOT APPOINTED A LOKAYUKTA

The Supreme Court sought explanation from chief secretaries of 11 states in two weeks on why they have not appointed Lokayukta and Uplokayukta, despite enactment of the law five years ago. The top court asked the chief secretaries to specify the reasons for not appointing the anti-corruption ombudsman in the respective states even after the law were enacted in 2013.

AYODHYA DISPUTE: SUPREME COURT TO EXAMINE IF 1994 RULING ON MOSQUE NEEDS TO BE REVISITED

NO PARKING FEES IN HYDERABAD MALLS AND MULTIPLEXES FOR FIRST 30 MINUTES: TELANGANA GOVERNMENT

The Telangana government issued orders to regulate the parking fee charged by commercial establishments in all urban areas of the state, including Hyderabad. According to the Government Order (GO), visitors of malls and multiplexes can park their vehicles for free for the first 30 minutes, starting from April 1. The GO states that no parking fee shall be collected for the first half an hour, which could be extended to one hour if the vehicle owner produces a bill of purchase from the mall or multiplex.

NO AUTOMATIC REGISTRATION OF FIR, ARREST IN CASES UNDER SC/ST ACT: SUPREME COURT

The Supreme Court on Tuesday banned automatic arrests and registration of criminal cases under the Scheduled Castes (SC) and the Scheduled Tribes (ST) Prevention of Atrocities Act, 1989. The court ruled that no arrests can be made under the act without prior permission. It also held that a court can grant a pre-bail arrest (anticipatory bail) if it, prima facie, finds the complaint is an abuse of the law, false, motivated and intended to blackmail or harass a person.

SUPREME COURT ASKED CENTRE TO TREAT LABOURERS IN CONSTRUCTION AS FORMAL SECTOR EMPLOYEES

The Supreme Court directed the central to treat construction workers as formal sector employees by bringing them within the ambit of social welfare laws and provide benefits like paid maternity leave, provident fund and minimum wage, and also directed the Centre to frame a scheme to ensure workers receive proper education, health, social security, old age, disability pension and other benefits necessary to live a dignified life.

TO PREVENT LOAN DEFAULTERS LEAVING THE COUNTRY, CORPORATE AFFAIRS MINISTRY MULLS PROPOSAL TO COLLECT PASSPORT DETAILS OF DIRECTORS

The Corporate Affairs Ministry is looking at a proposal to seek passport details of all individuals, who have been permitted to serve as directors on the board of companies. This move is to be taken to prevent loan defaulters like Nirav Modi and Mehul Choksi leaving the country. Sources said that prospective Director Identification Number (DIN) seekers will have to submit passport details for obtaining the 8-digit unique ID provided by the ministry.

RAM SETHU WILL NOT BE DAMAGED FOR SETHUSAMUDRAM PROJECT: CENTRE TOLD SUPREME COURT

The Centre informed the Supreme Court that “in the interest of the nation” it would not damage Ram Sethu, an underwater coral formation in the Indian Ocean that some believe was built by Hindu god Ram, and said that it will explore an alternative alignment for its Sethusamudram Ship Channel project off the coast of Tamil Nadu.

SUPREME COURT REJECTED ALL INTERIM PLEAS SEEKING TO INTERVENE IN AYODHYA DISPUTE CASE

The Supreme Court rejected all interim pleas seeking to intervene as parties in the Babri masjid-Ram temple land dispute case. A special bench comprising Chief Justice Dipak Misra and Justices Ashok Bhushan and S A Najeeb accepted the contention that only original parties to the dispute be allowed to advance arguments in the case and the intervention applications of unrelated persons seeking impledment as parties be rejected.

E-PETTY APP NOW AVAILABLE ACROSS ALL DISTRICTS IN THE TELANGANA STATE

The e-Petty App released in Hyderabad police commissionerate in 2016 to deal with petty offences has now been launched across all districts in the Telangana state. This APP will help officers register cases immediately on the spot, through a tab on the online platform. The App will help capture photographs of suspects/accused, record details of crime scene, and geo tag location of crime scene, digitally collect other evidence available. It will generate an automatic charge-sheet based on evidence which will be filed in court during trial.

SUPREME COURT EXTENDED AADHAAR LINKING DEADLINE TILL IT PASSES VERDICT ON VALIDITY OF THE AADHAAR SCHEME

The Supreme Court indefinitely extended the deadline for linking Aadhaar with mobile phones, tatkal passports and for opening bank accounts from March 31, 2018 till the Constitution Bench led by Chief Justice of India Dipak Misra pronounces its final verdict on the validity of the Aadhaar scheme. However, it clarified that the extension would not be applicable for availing services, subsidies and benefits under Section 7 of the Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016.

SUPREME COURT SAID THAT FOREIGN LAW FIRMS, LAWYERS CAN'T PRACTISE IN INDIA

The Supreme Court ruled that foreign law firms or foreign lawyers cannot practise law in the country either on the litigation or non-litigation side. However, the Court said that foreign law firms or foreign lawyers can visit India for a temporary period on a “fly in and fly out” basis for giving legal advice to their clients on foreign law or their own system of law and on international legal issues.

HYDERABAD HIGH COURT ISSUED NOTICES TO 22 MLAS OF ANDHRA PRADESH ASSEMBLY WHO WERE ELECTED ON YSRCP TICKET BUT LATER SHIFTED TO THE RULING TDP

The Hyderabad High Court issued notices to 22 MLAs who were elected on the YSRCP ticket and switched loyalties to the TDP without resigning their MLA posts. The court gave notices before admitting a public interest petition filed by former MLA Anna Venkata Rambabu of Markapuram in Prakasam district, who was seeking disqualification of all the legislators under the provisions of the anti-defection law, and the bench also issued notices to the AP state law secretary and legislative assembly secretary for filing counter affidavits on the issue.

SUPREME COURT ASKED ALL STATE HIGH COURTS IN INDIA TO FILE REPORTS ON PENDING POCSO CASES

The Supreme Court sought a district-wise data on cases pending under the Protection of Children from Sexual Offences (POCSO) Act from the Registrar Generals of High Courts across the country. The petition, filed by Advocate Alakh Alok Srivastava, had also sought framing of guidelines that investigation and trial of the cases under POCSO should be completed within six months from the date of registration of FIR.

SUPREME COURT LEGALISED PASSIVE EUTHANASIA AND ALLOWED LIVING WILL WITH SOME GUIDELINES

The Supreme Court legalised passive euthanasia by recognising that a person has right for a dignified death, and also allowed to make an advance ‘living will’ made by terminally-ill patients for passive euthanasia. A ‘living will’ is a written document by way of which a patient can give instructions that his or her life should not be prolonged with an artificial support system when he or she has reached an irreversible stage of terminal illness.

ON FRIDAY SUPREME COURT WILL PRONOUNCE ITS VERDICT ON RECOGNITION OF 'LIVING WILL' FOR PASSIVE EUTHANASIA

The Supreme Court is likely to pronounce its judgement on a petition seeking recognition of ‘living will' made by terminally-ill patients for passive euthanasia(it is a condition where there is withdrawal of medical treatment with the deliberate intention to hasten the death of a terminally-ill patient). Living will is a written document that allows a patient to give explicit instructions in advance about the medical treatment to be administered when he or she is terminally ill or no longer able to express informed consent.

SUPREME COURT SAID THAT HADIYA’S MARRIAGE VALID AND SET ASIDE KERALA HIGH COURT ORDER

The Supreme Court restored the marriage of Hadiya, aka Akhila Asokan, with Shafin Jahan, and set aside the Kerala High Court order that annulled her marriage as she converted to Islam to marry a Muslim man However, the Court permitted the National Investigation Agency (NIA) to continue with its probe into the alleged criminal phenomenon of ‘love jihad’ and take it to its logical conclusion in accordance with law.

COMPREHENSIVE GUIDELINES TO PROTECT INTER-CASTE COUPLES: SUPREME COURT

To protect inter-faith, inter-caste and intra-gotra couples whose marriages are opposed by society in the name of tradition, the Supreme Court said that it would frame comprehensive guidelines for their protection, and reserved the judgment on a petition by NGO Shakti Vahini seeking directions to curb honour killings and interference of khap panchayats in inter-caste marriages.

MARCH 31, 2018 AADHAAR LINKING DEADLINE MAY BE EXTENDED: CENTRE TO SUPREME COURT

The Centre indicated in the Supreme Court that the deadline for mandatory linking of Aadhaar to avail various services and welfare schemes run by the government may be further extended beyond March 31, 2018. The Centre also said that since some more time would be needed to conclude the prolonged hearing in the Aadhaar case, the government may extend the deadline from March 31, 2018.
