EXCLUDING GENETIC DISORDERS FROM INSURANCE POLICIES IS ILLEGAL: DELHI HIGH COURT

While hearing a petition filed by Jai Prakash Tayal against United India Insurance, the Delhi High Court ruled that the right to health insurance is an integral part of the right to health and healthcare under Article 21 of the Constitution, and held that discrimination in health insurance against individuals based on their genetic heritage, in the absence of appropriate genetic testing and laying down of intelligible differentia, is unconstitutional.
