HARYANA CABINET GIVES NOD TO DEATH PENALTY TO THOSE ACCUSED PERSONS WHO RAPE MINORS AGED 12 OR LESS

The Haryana government gave its permission to a proposal to bring in a legislation that would have a provision awarding death penalty to those guilty of raping girls aged 12 years or less, also decided to make the existing criminal laws related to sexual offences more stringent, decided to amend legal provisions like section 376A (Intercourse by a man with his wife during separation), 376D (rape by one or more persons constituting a group), 354 (Assault or criminal force against woman with intent to outrage her modesty) and 354 D(2) (stalking) of Indian Penal Code (IPC).

TELANGANA GOVERNMENT INFORMED HYDERABAD HIGH COURT ABOUT DEATH OF CHILDREN IN SISHU GRUHAS

Telangana government told the Hyderabad High Court that the children who died in Sishu Gruhas were those who were abandoned and their health was already deteriorated at the time of their entry into the home. Despite proper medicare, about 18 children have died from January 2017 to January 2018.

SAREE GUARD AND HAND GRIPS MIGHT BECOME MANDATORY FOR ALL TWO-WHEELER'S: SUPREME COURT

The Supreme Court has dismissed an appeal that was filed by the Society of Indian Automobile Manufacturers (SIAM) against the Madhya Pradesh high court order that banned the selling of all such two-wheelers that did not have safety essentials for pillion rider such as a saree guard or hand grips, and held that only two-wheelers which have saree guard and hand grips for pillion rider will be allowed to be registered to ply on Indian roads.

EXCLUDING GENETIC DISORDERS FROM INSURANCE POLICIES IS ILLEGAL: DELHI HIGH COURT

While hearing a petition filed by Jai Prakash Tayal against United India Insurance, the Delhi High Court ruled that the right to health insurance is an integral part of the right to health and healthcare under Article 21 of the Constitution, and held that discrimination in health insurance against individuals based on their genetic heritage, in the absence of appropriate genetic testing and laying down of intelligible differentia, is unconstitutional.

LIFE-TERM JAIL ONLY IN CASE OF PLANNED MURDER, NOT IN CASE OF UNINTENTIONAL MURDER: HYDERABAD HIGH COURT

Hyderabad High Court said that an accused will be sentenced to imprisonment for life if he kills a person with an intention. But the sentence will be modified by limiting it to a period up to 10 years if the accused has no intention or knowledge that his act will cause death of the deceased, and allowed the appeal of an accused (who got life imprisonment) by modifying the life sentence by limiting it to the period of sentence.

LINKING OF AADHAR COMPULSORY FOR NEW PATTA PASS BOOK, ELSE IT WILL BE TREATED AS BENAMI: KCR

Telangana chief minister K Chandrasekhar Rao has directed officials to link Aadhaar numbers with pattadar passbooks, to be distributed to farmers as part of Land Records Updation Programme (LRUP). Farmers who do not come forward to link their Aadhaar with passbooks, their land would be treated as benami land, he said.

SC ASKS IF KERALA HIGH COURT WAS JUSTIFIED IN ANNULLING HADIYA’S MARRIAGE

CENTRAL GOVERNMENT MUST GET A FREE HAND TO PROBE PUNJAB NATIONAL BANK FRAUD: SUPREME COURT

The Supreme Court said that the government must get a free hand to probe the over Rs 11,000 crore Punjab National Bank fraud case, involving billionaire jeweller Nirav Modi, and also said that it would step in only when agencies fail to carry out the investigation properly. The Court made this observation while hearing a Public Interest Litigation (PIL), seeking an independent probe and deportation of Nirav Modi.

HYDERABAD HIGH COURT SEEKS TELANGANA STATE GOVERNMENT RESPONSE ON DEATHS OF CHILDREN IN SISHU GRUHAS

A division bench of the Hyderabad High Court directed the Telangana government to file counter affidavit in a PIL case seeking action, including registration of criminal cases, against the officials responsible for the incidents of death of children and also sale of children in Sishu Gruhas in Telangana state being maintained under the Integrated child development services / Integrated Child protection scheme.

HYDERABAD SHE TEAMS REGISTERED 272 POCSO CASES IN 2017

Kavitha D, ACP of SHE Team said that in 2017, the Hyderabad SHE Teams had recorded 272 POCSO cases, of which 65 cases were severe in nature that is an average of 15 to 20 child abuse cases in a month, of which, nearly six cases are severe in nature. In January 2018 alone, the SHE Teams have received eight cases under Protection of Children from Sexual Offenses Act (POCSO), of which two were severe in nature.

SOON CHILD-FRIENDLY COURT AT BHAROSA CENTRE IN HYDERABAD

According to Hyderabad SHE Teams officials the Hyderabad city will have to wait for a couple of months more to get a child-friendly special court at Bharosa Centre at HACA Bhavan, Adarshnagar. Though the court’s infrastructure is likely to be in place by February-end, administration set-up may take time.

JUDGE LOYA DEATH CASE, ‘WE ARE TREATING CASE WITH HIGHEST AMOUNT OF SERIOUSNESS: SUPREME COURT

The Supreme Court made it clear that it was looking into the issue seeking probe into the death of former sessions court judge H.B. Loya as a ‘public cause’ and will not hesitate to order an investigation if it finds some suspicion in his death. The court made this observation when senior counsel Dushyant Dave, appearing for Bombay Lawyers Association made a fervent plea for a probe in public interest.

The Supreme Court has highlighted on the need for a proper case management system to ensure timely delivery of justice for appeals related to land disputes. For ease of doing business in so far as justice delivery is concerned, it is time to introspect and introduce case management programmes to streamline the system so that suits and appeals can be decided more efficiently. The Court made this observation while hearing an Appeal on a suit filed in 1987 for Specific Performance of an agreement to sell.

REVEAL SOURCE OF INCOME OF SELF, SPOUSE AND DEPENDENTS TO CONTEST ELECTIONS: SUPREME COURT TOLD POLITICIANS

The Supreme Court ruled that candidates those contesting elections should reveal the sources of their income as well as that of their spouses and children. As of now, a candidate is required to disclose details of assets and liabilities for self, spouse and three dependents while filing nomination paper but not the source of income. The order came on a plea by NGO Lok Prahari which sought an additional column in the candidates’ nomination papers, requiring them to disclose their sources of income as well as that of family members.

SUPREME COURT ASKED MADHYA PRADESH GOVERNMENT ABOUT PAYING ONLY RS. 6,500 TO SEX ASSAULT SURVIVORS

The Supreme Court asked the Madhya Pradesh government while questioning the state whether it was doing a charity by giving a measly Rs 6,500 to sex assault survivors. The apex court said that Madhya Pradesh, which was among the states which had received maximum funds from the Centre under the Nirbhaya Fund, was disbursing Rs 6,000-6,500 only to each rape survivor.

COURTS CANNOT MADE COMMUNALLY BIASED OBSERVATIONS: SUPREME COURT

The Supreme Court has criticised a Bombay High Court order granting bail to three accused in a 2014 sensational murder case of Pune-based techie Shaikh Mohsin and said a court cannot make observations which may appear to be coloured with a bias for or against a community. The top court set aside the order of Bombay High Court of January 12, 2017, by which it had granted bail to all the three accused in the case.

MORE THAN 50 LAKH CASES DISPOSED ON AN AVERAGE BY NATIONAL LOK ADALATS

Statistics compiled by the Law ministry showed that more than 50 lakh cases have been disposed of every year on an average in the last three years by the National Lok Adalats which are held every two months across the country.

HYDERABAD TRAFFIC POLICE STARTED BOOKING VEHICLE DRIVERS WHO ARE USING EAR PHONES WHILE DRIVING

The Hyderabad traffic police has started booking commuters caught using earphones or headphones while driving under Section 184 of the Motor Vehicles Act. The police are filing chargesheets against offenders instead of simply imposing fines, and detaining their vehicles. The traffic police will also book cases against those who use their mobiles while driving.

SUPREME COURT IS PLANNING TO FIX A TIME-FRAME FOR WRAPPING UP CRIMINAL APPEAL CASES

The Supreme Court is considering fixing a time-frame for wrapping up criminal appeal cases, especially in cases of non-heinous crimes. A bench said that steps were required to ascertain criminal cases did not remain pending for decades, which forces the accused to remain in jail for longer than the charges warrant. The Court made this statement based on a report submitted recently in the court had revealed that as many as 14 criminal appeals were pending for more than four decades. The oldest appeal is pending in the Allahabad High Court for 46 years.

EXCLUSION OF ANY SECTION OF SOCIETY FROM ACCESSING PUBLIC FACILITY WILL NOT TOLERATE: DELHI HIGH COURT

The Delhi High Court said that it would not tolerate exclusion of any section of society from accessing public facilities and directed the Centre, Delhi government and local bodies to be more sensitive to the needs of persons with disabilities. The observations came during the hearing of a PIL that claimed that most public facilities in the national capital were not disabled friendly.

SUPREME COURT ASKED THAT IS CENTRAL GOVERNMENT NOT ENTITLED TO SEEK IDENTIFICATION PROOF FROM CITIZENS

The Supreme Court posed whether the government was not entitled to seek proof of identity from citizens if their entitlement to certain benefits were dependent upon their identities.  The bench, hearing pleas challenging the constitutional validity of the Aadhaar scheme and the enabling 2016 law, said, "even if entitlement is beyond dispute, there has to be minimal way of proving who you are".

WOMEN AND CHILD DEVELOPMENT MINISTRY TO RECOMMEND LIFTING TIME BAR ON REPORTING CHILD SEXUAL

The Women and Child development (WCD) Ministry will seek a change in the Code of Criminal Procedure (CrPC) to allow filing of complaints of child sexual abuse many years after the crime. The secretary of WCD, R.K. Shrivastava, said at a press meet that they are in the process of writing to the ministry of home affairs (MHA) asking them to amend Section 473 of the Code of Criminal Procedure (CrPC). So, time limitation will go away, and allow victims to report such crimes even years later.

SUPREME COURT ASKED HOW CAN BE CONVICTED NETAS FLOAT OR HEAD POLITICAL PARTY AND ASKED CENTRE TO FILE REPLY ON THE ISSUE

The Supreme Court questioned whether convicted politicians can form and head a political party, can choose candidates for the polls after they are disqualified from contesting elections. The made this observation during the course of hearing of a PIL seeking ban on convicted persons from forming or being officer bearers of a political party. The Bench asked the Centre to file its response that it was supporting the ban.

CENTRAL GOVERNMENT IS PLANNING TO SET UP ANTI-HUMAN TRAFFICKING WING

The Centre is planning to set up a dedicated anti-human trafficking wing under a central investigation agency like the National Investigation Agency. The planned anti-trafficking wing will give a boost to efforts of investigators when the proposed Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2017, becomes a reality. At present a group of ministers (GoM), are examining the bill.

SUPREME COURT ADMITTED THAT CHILDREN TOO HAVE RIGHTS, AND ASKED CENTRE AND STATES TO IMPLEMENT JUVENILE JUSTICE ACT

The Supreme Court issued a slew of directions for effective implementation of the Juvenile Justice (Care and Protection of Children) Act, 2015 and asked the Chief Justices of all the High Courts to consider establishing child-friendly courts and vulnerable witness courts in each district.  The Court also asked the Centre and states to ensure that all positions in national and state commissions for the protection of child rights are filled up.

VIDEO OF SCHOOL PRINCIPAL CANING STUDENTS WENT VIRAL, POLICE TOOK THE CASE AS SUO MOTU AND BOOKED PRINCIPAL

Police booked a private school principal after a video went viral, showing one of its teachers canning students for allegedly not paying fees. According to the police, the incident in the video occurred at Gowtham Model School in December but came to light only recently. The video shows a bunch of students made to stand out of the classroom, with their hands stretched.

DON’T LET POOR SUFFER DUE TO LACK OF AADHAAR AUTHENTICATION: SUPREME COURT TOLD CENTRE

The Supreme Court made it clear to the Centre that no person should be denied social security benefits for non-possession of Aadhaar card and the benefits should continue to be extended to them on the basis of other forms of identity. The court made this observation while hearing for one of the petitioners complained that social security benefits are being denied to those who did not possess Aadhaar.

SUPREME COURT SAID THAT IT WOULD TREAT AYODHYA CASE AS A PURE LAND DISPUTE CASE, NEXT HEARING MARCH 14

The Supreme Court made it clear that it will deal with the Ram Janmabhoomi-Babri Masjid title dispute case “purely as a land dispute” and posted the batch of 14 appeals for hearing from March 14. The bench also expressed its reservation on hearing the matter on day-to-day basis and said once the matter will start it will go on in normal course.

WHAT IS WRONG IN ONE NATION, ONE IDENTITY, WE ARE ALL INDIANS: SUPREME COURT JUDGE

The Supreme Court said that there is nothing wrong in the “one nation-one identity” concept for citizens under the Aadhaar programme. The judge was responding to a submission made by senior advocate Kapil Sibal that a citizen may run the risk of being branded an “anti-national” if he or she is found without an Aadhaar.

FORGOT TO CHANGE CAR OWNERSHIP RECORDS AFTER SALE OF VEHICLE, PAY FOR MISHAPS: SUPREME COURT

The Supreme Court ruled that in case the previous owner of a vehicle fails to change the ownership status in the registration records, he or she will be liable to pay compensation fees arising out of any accidents that involve the vehicle even if another person owned and drove that vehicle, and also said that the original owner need not be held liable when there was clear evidence of sale of vehicle and the last owner admitting ownership.

DON’T DUMP JUNK, WE ARE NOT GARBAGE COLLECTORS: SUPREME COURT TO CENTRE

The Supreme Court pulled up the Centre for dumping junk before it in an 845-page affidavit containing incomplete information about solid waste management across the country saying that the top court is not a garbage collector.  The apex court made this statement while hearing a matter related to implementation of Solid Waste Management Rules 2016 across the country.
