BRING LAW FOR DAMAGES FOR STIR-RELATED VIOLENCE: SUPREME COURT

To decrease the loss of lives and damage to public property during agitations, the Supreme Court asked Centre to create courts in every state and union territory to fix accountability for vandalism and compensate the victims of such violent protests.

SUPREME COURT STRIKES DOWN STRINGENT BAIL CONDITION IN MONEY LAUNDERING CASES

Saying that the stringent bail provision under Prevention of Money Laundering Act (PMLA) as arbitrary and unconstitutional, the Supreme Court struck down Section 45 of the Act, paving the way for accused to get out on bail as per the provision applicable to other offences.

PAY RS 10 LAKH EACH TO 150 STUDENTS FOR ILLEGAL ADMISSIONS: SUPREME COURT DIRECTED MEDICAL COLLEGE

The Supreme Court directed a medical college in Lucknow to grant compensation of Rs 10 lakh each to the 150 students it had admitted in the MBBS course without formal permission from the government, and slapped a fine of Rs 25 to the college that to be paid to the Supreme Court registry.

SUPREME COURT ASKED CENTRE TO REPLY ON RECORDING OF PROCEEDINGS

The Supreme Court granted time to the Centre till Friday to respond to the proposal for audio and video recording of all court proceedings. At present there is no recording of the court proceedings.

CANNOT BLOCK ‘BLUE WHALE CHALLENGE GAME: CENTRE TOLD THE SUPREME COURT

The Centre told the Supreme Court that it is not possible to block online games like the ‘Blue Whale Challenge’ as they are not app-based games, and said that game was being communicated by one-to-one communication through encrypted/ secretive communication links. Hence it is difficult to identify, intercept and analyze the contents.

DON’T ADMIT PIL ON BASIS OF CONFIDENTIAL REPORTS: CENTRE TO SUPREME COURT

The Centre said to the Supreme Court not to entertain any petition filed on the basis of documents like leak of confidential reports and file notings of governments and various agencies, including the CBI and the Enforcement Directorate, and the Supreme Court said that they must ask the petitioner to reveal the name of the whistleblower or the source of information before entertaining the petition.

SUPREME COURT SAID FILMMAKERS SHOULD BE ALLOWED FREEDOM OF SPEECH

A three-Judge Supreme Court bench had refused to stay the release of ‘An Insignificant Man’, the film on the Delhi Chief Minister and asked the judiciary to go slow on stopping the release of a film, drama, book or novel. The bench also said that the artists, authors, filmmakers and dramatists have the right to freedom of expression, which cannot be challenged by others whimsically.

HYDERABAD HIGH COURT SAID THAT SUB-REGISTRAR CANNOT CANCEL SALE DEED ON TAHSILDAR’S WORD

The Hyderabad High Court set aside an order of a single judge who held that the sub registrar had the power to cancel sale deeds on the recommendation of the tahsildar concerned. The single judge in September had upheld the action of the joint sub-registrar-I, Sangareddy, who on August 16 had cancelled the deeds registered in 2007.

COMPLAINTS ON FOOD ADULTERATION SHOULD BE FILED IMMEDIATELY WITHOUT INORDINATE DELAY

As Per law, no prosecution can be continued against the accused persons for the offense punishable under the Prevention of Food Adulteration Act if there has been an inordinate delay in filing the complaint against them.  According Section 11 (4) of the Act mandates that the food samples seized shall be produced before a magistrate as soon as possible, and not later than 10 days after receipt of the report of public analyst.

MEGA SCAM IN RECRUITMENT OF POSTMEN VACANCIES IN MAHARASHTRA

The Bombay High Court refused to grant pre-arrest bail to P V Mallya(Director of Manipal Technologies Limited (MTL)). He applied for pre-arrest bail that the Mumbai police registered an FIR in August against Manipal Technologies Ltd (MTL), which had won a bid in 2015 to conduct the recruitment process for postmen, mail guards and other staffers in the postal department after the vigilance department of the Department of Posts has unearthed a mega scam in recruitment for over 2,400 vacancies, in Maharashtra.

CHIEF JUSTICE OF INDIA IS 'MASTER OF ROSTER’: SUPREME COURT BENCH, AND ANNULLED ORDER PASSED BY JUSTICE CHELAMESWAR BENCH

The Constitution bench of the Supreme Court held that the Chief Justice of India is the ‘master of roster’ and annulled an order passed by Justice Chelameswar by taking over to himself the case relating to alleged medical scam saying that CJI alone can assign cases to different benches and decide the composition of benches. Chelameswar issued directions to set up a bench with top five judges to hear case relating to medical scam.

MEDICAL ADMISSION SCAM: TOP 5 JUDGES TO DECIDE ON PROBING JUDGES

The Supreme Court set up a bench of the five most senior judges to examine whether a retired CJI supervised Special Investigation Team (SIT) probe was required into allegations that middlemen were in nexus with judges of higher judiciary in a racket to fix orders to enable admissions into medical colleges debarred from admissions for poor infrastructure.

TAX OFFICIALS RAID ON PROPERTIES LINKED TO SASIKALA AND RELATIVES

GOVERNMENT PORTAL SHE-BOX OPENED FOR PRIVATE ORGANISATIONS TO REGISTER SEXUALLY HARASSMENT COMPLAINTS AT WORKPLACE

Ministry of Women and Child Development said that women facing sexual harassment at workplace in private organisations and fearful of reporting it to the internal complaints committee can now send an SOS to the SHe-Box of the ministry of women and child development who will then take up the matter with their employers. The portal Launched in July and it was for women working in or visiting central government departments and now it is extended on complaints related to the private sector.

GUJARAT HIGH COURT TO DECIDE IF FORCED CONJUGAL ORAL SEX RAPE, SODOMY OR CRUELTY

The Gujarat High Court is to decide whether forcing the wife to perform oral sex was sodomy, rape or marital cruelty, and if a man could be tried on these charges. The Court is hearing a man's plea for the quashing of an FIR filed against him on his wife's complaint, and also asked the state government's explanation on the IPC sections applicable in the matter, and also issued notice to the woman.

Over the past three years, the SHE Team has nabbed 1,464 persons red-handed and solved 3,516 cases. Kavitha, ACP of SHE Team said that they had apprehended 363 minors and 1,101 adults for stalking (32 per cent), passing lewd remarks (20 per cent), harassment over phone (20 per cent) and inappropriate touching (3 per cent).

1000 CASES BOOKED ON MALLS AND MULTIPLEXES FOR COLLECTING GST OVER MRP

Legal Metrology Department officials have conducted raids at malls and multiplexes and booked over 1,000 cases for collecting GST over maximum retail price (MRP). Commissioner, civil supplies, and controller, legal metrology, CV Anand said GST frauds were reported at several places from local shops to shopping malls and multiplexes.

SPECIFY DEADLINES IN SMS FOR AADHAAR LINKING: SUPREME COURT TOLD TO MOBILE SERVICE PROVIDERS AND BANKS

The Supreme Court directed banks and telecom service providers to alert subscribers about the last date to link their accounts and mobile phones with Aadhaar to prevent panic among users about accounts being frozen and phones being disconnected. Deadline for Aadhaar-bank account linkage is December 31, 2017 and February 6, 2018 for mobile phones.

CYBERABAD POLICE WILL SEIZE CARS IF THERE IS NO THIRD PARTY INSURANCE

Cyberabad police said they will seize vehicles that do not have third party insurance and have given citizens a 15-day window period to get one. Cops said they will now seize such vehicles and not release them until they are adequately covered.

The Supreme Court has suspended the Engineering degrees granted between 2001 and 2005 through distance learning by four deemed universities JRN Rajasthan Vidyapeeth, Institute of Advanced Studies in Education in Rajasthan, Allahabad Agricultural Institute and Vinayaka Mission's Research Foundation in Tamil Nadu. However, Students who took admission between 2001 and 2005 to revive their degree by undergoing a fresh examination to be conducted by AICTE. The court also restrained all deemed universities across the country from continuing any distance learning courses from the 2018-19 without prior approval of the regulatory authorities.
