SUPREME COURT REFERRED AADHAAR CASES TO A FIVE JUDGE CONSTITUTION BENCH

A Supreme Court bench headed by Chief Justice Dipak Misra referred a large number of petitions questioning the validity of Aadhaar to a five judge bench, which will commence hearing in the last week of November.

The Madras High Court dismissed a public interest litigation (PIL) petition filed by a lawyer seeking a direction to the Central Board of Film Certification (CBFC) to revoke the censor certificate issued to Vijay starrer Mersal for its ''anti GST'' dialogues, and said that dialogues were a mere expression of opinion in a film, so courts cannot interfere and order their deletion.

CENTRE PROPOSES TO EXTEND AADHAAR LINKING DEADLINE TO THOSE ‘WILLING TO ENROL’

The Central government told to Supreme Court that it has proposed extending the deadline for mandatory linking of Aadhaar with bank accounts, mobile phones and to avail social welfare schemes from December 31, 2017 to March 31, 2018, but only exclusively for those who are willing to enrol for Aadhaar. The people who have Aadhaar will have to stick to the Dec 31, 2017 deadline.

CENTRE THINKING BEYOND AADHAAR TO VERIFY MOBILE CONNECTIONS

The government will soon put in place a mechanism for authentication of mobile subscribers who do not have Aadhaar numbers. It may also explore another method for people unwilling to share their Aadhaar numbers with telecom companies. Such a method will conform with the Supreme Court’s mandate on re-verification of mobile subscribers.

PANEL TO TAKE CALL ON URGENT ABORTIONS: SUPREME COURT TO HEAR PETITION

The Supreme Court has refused to direct the Centre to amend the Medical Termination of Pregnancy (MTP) Act for allowing abortion beyond the legally permissible period of 20 weeks. However, it has agreed to hear a plea for the setting up of a permanent mechanism for the expedient termination of pregnancies over 20 weeks long in cases involving rape survivors and abnormal fetuses. The court, however, issued notice to the Centre seeking its response on instituting a mechanism for allowing the termination of pregnancies beyond 20 weeks in exceptional cases.

UNACCOUNTED MONEY LENT BY MONEYLENDER NOT LEGALLY RECOVERABLE

The Hyderabad High Court said that the amount lent by the moneylender to the borrower is not recoverable if such money is ‘unaccounted for’ money or he does not possess any licence for doing moneylending business, and the offence punishable under Section 138 of the Negotiable Instruments Act, 1881, and the court held that the amount lent by complainant to the accused is unaccounted money as the complainant did not possess any licence for doing moneylending business.

HIMACHAL PRADESH HIGH COURT ALLOWED ABORTION OF 32-WEEK-OLD FOETUS OF 19-YR-OLD GIRL

The Himachal Pradesh High Court has allowed abortion of a 32-week-old fetus of a 19-year-old rape survivor, who has mild to moderate mental retardation on the on the ground that it is risky for her to complete the normal period of pregnancy and deliver the child on the due date.

SOON GUIDELINES ON PARKING FEE COLLECTIONS BY COMMERCIAL COMPLEXES IN HYDERABAD CITY

As of now, there are no guidelines on parking fee collections by the shopping malls and multiplexes in the Hyderabad city. But now the Municipal Administration and Urban Development (MA&UD) department has decided to issue directions to managements of commercial establishments not to collect parking fees from visitors. The Greater Hyderabad Municipal Corporation chief city planner said that state government will soon issue necessary directions to the managements to provide free parking to visitors.

The Supreme Court declined to amend an Act which prohibits termination of pregnancy beyond 20 weeks saying that the issue fell within the legislative realm. SUPREME COURT TO EXAMINE CONCEPT OF ‘LIVING WILL’

The Supreme Court decided to examine the more complex concept of a ‘living will’ where removal of life support is authorised in case of an irreversible coma. A ‘living will’ is a document prepared by a person in a healthy state of mind specifying that if she slides into a vegetative state because of an irreversible terminal illness. In such a case, relatives will be spared the agonising decision of removing life support and doctors will be guided solely by the ‘living will’.

CENTRE PANEL ON SECTION 66A PITCHES FOR CHANGES IN LAW TO COUNTER HATE SPEECH ONLINE

In order to deal with cases of hate speech online, use of cyberspace to spread hatred and incitement, an expert committee, constituted by the Centre, has recommended that the Indian Penal Code, Code of Criminal Procedure and the IT Act be amended in order to introduce stringent provisions for the same. The expert committee was constituted after the Supreme Court struck down the controversial Section 66A of the Information Technology Act in 2015.

HYDERABAD CID REGISTERED A CASE AGAINST WEBSITES FOR UPLOADING OBSCENE PHOTOGRAPHS OF CINE STARS

Telangana Crime Investigation Department (CID) sleuths have registered a case against 21 websites and YouTube channels for posting vulgar content against Tollywood artistes, including actors. The case was registered after Movie Artist Association (MAA) president Shivaji Raja, general secretary Naresh and secretary Hema had lodged a complaint with the Cyber Crime police station of CID alleging that 21 websites and YouTube channels were posting vulgar content against Tollywood actresses.
