GUJARAT HIGH COURT RULED THAT A CONVERT DAUGHTER CAN GET DAD'S PROPERTY

The Gujarat High Court has ruled that a Hindu woman who married a Muslim man and refused her Hindu faith to hold Islam is entitled to inherit her father's ancestral property according to the Hindu Succession Act, and concluded that the ‘The Hindu Succession Act does not disqualify a convert (from inhering ancestral property). It only disqualifies the descendants of the convert’.

CONSUMER FORUM IMPOSED A FINE OF 10LAKH TO ESI HOSPITAL FOR CAUSING DISABILITY TO A PATIENT

A Hyderabad city-based district consumer forum has directed the ESI Hospital at Sanathnagar to pay a compensation of Rs 10.83 lakh to a patient who was rendered permanently disabled due to the inability of the hospital's doctor to correctly diagnose the vascular compromise caused by a road accident. Apart from the compensation, the patient was also awarded Rs 10,000 towards costs.

DELHI HIGH COURT ASKED CENTRE TO DEFINE RAPE WITHOUT GENDER BIAS

Based on the petition filed by Sanjjiiv Kkumaar, an activist seeking gender neutral definition of anti-rape criminal laws, Delhi High Court sought the Centre's response on the plea, seeking to declare ‘gender-specific’ sections related to rape and its punishment under Indian Penal Code (IPC) as unconstitutional.

MAHMOOD FAROOQUI, 'PEEPLI LIVE' CO-DIRECTOR, ACQUITTED IN RAPE CASE

The Delhi High Court acquitted Peepli Live co-director Mahmood Farooqui of raping a US citizen, setting aside a lower court verdict sentencing him to seven years in jail. The court, in its judgment, said there were doubts whether such an incident took place in the manner alleged by the woman concerned, ‘and even if it did occur, (there is lack of clarity on) whether it was without the consent/will of the prosecutrix,’ it added.

LISTENING TO LOUD MUSIC WHILE DRIVING IS AN OFFENCE

The Road Transport Ministry has notified detailed regulations for drivers, which include dozens of dos and don'ts, and stated that violation of these norms notified under the Rules of Road Regulations is an offence under the Motor Vehicle Act. Now traffic police can impose higher fine and can even confiscate the licence if they find that ‘playing loud music while driving or watch videos except for navigation’ and ‘skipping stopping at pedestrian crossings or drive on footpath or do you use an air horn or multi-toned horn’, and ‘driving more than the specified speed limit while passing by a school or a hospital or a construction site’.

ROHINGYAS WILL BE DEPORTED, SAID CENTRE TO SUPREME COURT

The Centre through an affidavit told the Supreme Court that the decision to deport 40,000 Rohingya Muslims, who are illegal immigrants from Myanmar, has been taken keeping in mind national security threats, and also said that some Rohingyas are indulging in illegal and anti-national activities. Along with this the Centre also said that being a policy decision, the court should not interfere with it.

CENTRE PLANS TO MAKE PAN MANDATORY FOR COMPANIES AND NGOs

The Central government is planning to make Permanent Account Number (PAN) mandatory for businesses as well as non-government organisations as it looks to close possible gaps for generation of black money. Sources told that the Ministry of Corporate Affairs (MCA) has proposed amendments to the Income Tax Act as well as the Prevention of Money Laundering Act and the government is looking at a mechanism under which any entity with cumulative transactions of over Rs 2 lakh annually will have to comply with the regulations.

NO ABSOLUTE EXEMPTION TO CBI FROM RTI ACT, SAID BY DELHI HIGH COURT

The Delhi High Court held that the Central Bureau of Investigation (CBI) cannot claim absolute exemption from disclosing information pertaining to allegations of corruption and human rights violations held by it under the Right To Information (RTI) Act, and the CBI has been denying information citing Section 24 of the Right to Information (RTI) Act, which says that its provisions will not apply on intelligence and security organisations, which also include IB, RAW, NIA and the Enforcement Directorate.
